Initial Consultations are Free

At Murray Ralston we are pleased to provide a free initial consultation. During the initial
consultation we will learn about your accident, your injuries and the impact it has had on
your life so far. We will answer your questions regarding the legal process and give
some initial feedback on your case.

No Up-Front Legal Costs

When people are injured in an accident they are often severely challenged financially as
the direct result of their injuries. At Murray Ralston we work on a Contingency Fee
basis. We pay all upfront costs to obtain medical records, hire experts, pay court filing
fees, etc. so there is no out-of-pocket expense for you. At the end of the action, if you
are successful, we recover these out-of-pocket expenses and charge you a percentage
of the amount of money recovered over and above those expenses. For personal injury
actions (not medical malpractice) the maximum percentage we charge is 33%. In less
complex and simpler cases the percentage may be lower.

Initial Consultations are Free

At Murray Ralston we are pleased to provide a free initial consultation. During the initial
free consultation we will gather information from you regarding the nature of the medical
treatment that has caused you injury and the impact of that injury on your life to date.
We will answer your questions and provide you information regarding the process
should you choose to proceed. We do there is never any charge for this initial
consultation.

Legal Costs

Medical Malpractice actions are almost always hard fought by the defendants. Because
of the considerable costs that are almost always associated with prosecuting medical
malpractice actions, Murray Ralston believes that it is usually best to do an initial
investigation and obtain an understanding of the medical treatments/results at issue
before pushing forward with a law suit. While this is often done before a claim is issued
in the courts, given the limitation periods in Ontario, there often is not enough time to
conduct that investigation before starting the litigation.

For that reason Murray Ralston often enters separate retainers, one dealing with the
initial investigation and one dealing with the prosecution of the action. The initial
agreement is never done on contingency. It is always a limited scope retainer
agreement and the terms are always tailored specific to each client’s needs and
circumstances.

If the client decides to retain us to pursue an action and Murray Ralston agrees to
prosecute that action, the second phase retainer is always a contingency agreement.
Murray Ralston will never charge more than 35% of the total award (after subtracting
disbursements). Often, depending on the nature of the specific case, the percentage
we agree to charge is lower.

DISABILITY CASES

Short and long term disability insurance coverage typically entitles a person to receive
monthly benefits for a specific percentage of their income if they suffer disabilities that
render them incapable of working. Often insurance companies deny paying benefits for
people who truly are disabled from working, despite the evidence of treating medical
practitioners.

Murray Ralston understands the impact of an insurance company wrongfully denying
benefits for people who are already disabled from working due to medical conditions.
We strive to reduce your stress by vigorously pursuing your right to benefits while
dealing with you compassionately and respectfully.

Free Initial Consultation

At Murray Ralston your intitial consultation on disability cases is always free. During the
initial consultation we gather information about your case, answer questions you might
have regarding the legal process and provide you initial feedback on your case.

No Up-Front Legal Costs

If we take your disability case we will work for you on a Contingency Fee basis. We pay
all upfront costs to obtain employment files, medical files, expert reports and litigation
filings. We wait until you recover money before we recover these costs. In addition, we
charge an agreed upon percentage of the total award (after deducting the out-of-pocket
expenses). The fee for short term and long term disability retainers is never more than
33% plus HST. In cases that are simple and straightforward the percentage agreed
upon can be lower.
