Pedestrian and Car Accidents

Pedestrians who are hit by automobiles are usually entitled to the same legal rights to recover compensation from a negligent driver as a person who is injured in a typical car accident. Injured pedestrians are also entitled to “no-fault” or car accident benefit coverage.

If the pedestrian does not have his or her own car insurance, the injured pedestrian is still entitled to accident benefits (no-fault car insurance benefits) from the driver’s insurance. The injured pedestrian may be entitled to accident benefits even if he or she was partly or fully responsible for his or her own injuries in the car accident / pedestrian accident.

In addition to receiving accident benefits, a pedestrian can sue the negligent driver responsible for the car accident / pedestrian accident for those damages that the accident benefits don’t cover.

Contributory negligence is often a factor in car accident / pedestrian accidents.

Contact Murray Ralston Lawyers for a no-fee consultation if you, your child, or a loved one has been injured in a pedestrian / car accident. Remember that there is a limited time to bring a court action, or you will lose your right to sue. Murray Ralston Lawyers represents car accident victims throughout Ontario.
